MONTRÉAL, Sept. 24, 2014 /CNW Telbec/ - Effective today, enterprises wishing to enter into certain supply or service contracts with the Ville de Montréal involving an expenditure equal to or greater than $100,000, as well as certain subcontracts involving an expenditure equal to or greater than $25,000, must first be granted an authorization issued by the Autorité des marchés financiers ("AMF").
Under an Order in Council published today in the Gazette officielle, the Québec Government requires enterprises to obtain an authorization from the AMF to enter into a contract or subcontract with a public body if they are competing in a call for tenders or an award process that begins as of September 24, 2014 for contracts for the supply of bituminous compounds and service contracts for the construction, reconstruction, demolition, repair or renovation of roads, waterworks or sewer services of Ville de Montréal, namely:
- contracts involving an expenditure equal to or greater than $100,000;
- subcontracts directly or indirectly related to such contracts and involving an expenditure equal to or greater than $25,000.
Since October 23, 2013, enterprises have also been required to obtain an authorization from the AMF if they are competing in a call for tenders or an award process for contracts for the construction, reconstruction, demolition, repair or renovation of roads, waterworks or sewer services of Ville de Montréal involving an expenditure equal to or greater than $100,000 and subcontracts of the same nature directly or indirectly related to such contracts and involving an expenditure equal to or greater than $25,000;
Public contracts valued at over $5 million soon covered under the Act
The value, categories and groups of contracts for which enterprises must obtain an authorization are indicated the Orders in Council issued by the Government of Québec. As of October 24, 2014, enterprises must also obtain an authorization if they will be competing in a call for tenders or an award process for public service and construction contracts and subcontracts and public-private partnership contracts involving an expenditure equal to or greater than $5 million. These enterprises are encouraged to submit their applications for authorization without delay.

Québec enterprises that wish to file an application must use our E-Services. To use these on-line services securely, they must have a clicSÉQUR business account.
Enterprises seeking to do business with Québec public bodies are encouraged to sign up for E-mail Info - Public contracts to receive up-to-date information about changes to contract values, categories and groups.
Enterprises that are issued AMF authorization are immediately entered in the Register of business enterprises authorized to enter into public contracts and subcontracts available on the AMF website.
