Appeal Court Directs Acquittals in Guns and Drugs Case

TORONTO, Dec. 12, 2013 /CNW/ - The Court of Appeal for Ontario released its judgment this morning in R. v. Yowfoo and allowed Clinton Yowfoo's appeal. 

Mr. Yowfoo had been convicted of a number of gun and drug offences at trial.  The police had found a large amount of firearms, ammunition, cocaine, heroin and methamphetamine in a locked closet of a stash house, which they believed was connected to Mr. Yowfoo.  The trial judge found that Mr. Yowfoo knew of and had control over these items based entirely on circumstantial evidence.  As a result, Mr. Yowfoo was sentenced to 12 years.

Today the Court of Appeal disagreed.  The Court of Appeal concluded that there was not enough evidence to tie Mr. Yowfoo to the guns and drugs in the locked closet.  As a result, the Court overturned the convictions and directed acquittals.
