Canada-wide Class Action Being Launched in Court Today Regarding Fiat Chrysler "Defeat Devices" Designed to Deceive Emission Testing

On Friday, Merchant Law Group's Toronto office moved first to file class action litigation against Fiat Chrysler with the Ontario Superior Court regarding vehicles alleged to contain "Defeat Devices", including all 2014, 2015, and 2016 Dodge RAM 1500s equipped with a 3L diesel engine, and all 2014, 2015, and 2016 Jeep Grand Cherokees equipped with a 3L diesel engine. A B.C. Supreme Court Class Action is being filed today with the Court in Vancouver, as well as similar litigation to be filed in the Court of Queen's Bench in Alberta, as part of Canada-wide class action litigation against Fiat Chrysler Automobiles N.V. and FCA CANADA INC.
These class action lawsuits come on the heels of a Notice of Violation being lodged against Fiat Chrysler by the Environmental Protection Agency (EPA) https://www.epa.gov/fca/learn-about-fca-violations which is investigating the presence of several undisclosed emission control devices which may constitute "defeat devices" found to be present in diesel Dodge RAM 1500s trucks and Jeep Grand Cherokees for the last three years.
"Fiat Chrysler vehicle owners with affected vehicles are understandably concerned. The EPA investigation alleges that the Fiat Chrysler vehicles in question contain at least eight auxiliary emission control devices that reduce emission controls when driving at high speeds or during extended distances. That means these vehicles often emit what the EPA defines as a harmful level of nitrogen oxides, which in turn prompts the need for class action litigation on behalf of Jeep Grand Cherokee and Dodge 1500 diesel truck owners." said Tony Merchant, Q.C.
