Daycare Operator Sues Ontario Ministry of Education for $26 Million
TORONTO, April 10, 2014 /CNW/ - Tiny Town Daycare, an Ontario daycare provider, has commenced legal proceedings against the Ontario Ministry of Education in a Court document that has been filed by way of a Statement of Claim issued on April 9, 2014 (the "Claim") (Court File No. CV-14-501759) and with an affiliate claim against its licensing and compliance inspectors (Court File No. CV-14-501761).
In the Claim, Tiny Town Daycare seeks damages in the amount of $26 million against the Ontario Ministry of Education. The lawsuit alleges that unlawful actions, with respect to licensing and compliance issues, have been taken against the daycare and its president, including intentional interference with management and operations, intent to defraud, defamation, malicious prosecution, breach of contract, and collusion and conspiracy.
Tiny Town Daycare also alleges in the Claim that agents of the Ontario Ministry of Education have conspired to disrupt and destroy the daycare business, by false and unproven allegations related to ministry inspections. Furthermore, the President of Tiny Town Daycare, Mr. Gerald Jutsun, also alleges that the Ministry of Education engaged in collusion with a former employee of Tiny Town Daycare in breach of trust against the company. The former employee is also the subject of a Statement of Claim in court. (Court File No. CV-14-499390).
The Claim is being filed in tandem with actions by FSI Fraud Security Investigations (www.fsifraud.com), a highly specialized fraud investigative firm. Mr. Jutsun is also the President of FSI Fraud Security Investigations, and became the President of Tiny Town Daycare when he and investors acquired the company over a year ago.
Mr. Jutsun states the following, "The daycare licensing process is something akin to the 17th century Spanish Inquisition. I want to confess the truth. I just need to know what the truth is…so that I can confess to it!"
Mr. Gerry Jutsun did beseech the Minister of Education, the Honourable Liz Sandals, in December 2013 to look into the matter, but did not receive any response.
Mr. Jutsun and FSI Fraud Security Investigations are also inviting any other daycare operators who may have had their licenses forfeited, revoked or felled with a provisional license, to come forward so that he may investigate the circumstances of their licensing de-commissioning.
