"Mayor Hawa's comments are unduly reassuring for citizens!"
SAINTE-ANNE-DE-BELLEVUE, QC, Aug. 22, 2017 /CNW Telbec/ - Société Développement Immobilier Sainte-Anne-de-Bellevue (DISAB) is responding to comments made by Paola Hawa, Mayor of Sainte-Anne-de-Bellevue, following a judgment rendered by Superior Court on August 7 regarding a legal dispute between a developer and the City of Beaconsfield.
"Mayor Hawa is once again showing bad faith and is wrong to claim that there are many similarities in the two cases," say Sylvain Ménard, Raymond Allard and Jean Houde of DISAB. "The facts in the Beaconsfield case are totally different from those that concern us, especially since the developer did not claim any damages and no PPU or concordance by-laws barring the development had been adopted by the City."
"The Mayor's comments in response to the Beaconsfield ruling are therefore unduly reassuring for citizens, especially since she carefully avoids speaking about the decision in the Saint-Colomban case in which Superior Court fined the municipality $4,008,900 for having expropriated the real estate developer in a disguised manner. There are many similarities between the facts of the Saint-Colomban case and our case, including the disguised expropriation resulting from the adoption of a zoning by-law aimed at preventing the developer from using his property," they added.
DISAB is the victim of a disguised expropriation in the development file for the northern sector of Sainte-Anne-de-Bellevue. In early July, it filed a lawsuit totalling more than $35 million in Superior Court against the municipal administration of Sainte-Anne-de-Bellevue following the adoption of the special planning project (PPU).
