MONTRÉAL, March 7, 2016 /CNW/ - A hearing was held before a Hearing Panel of the Investment Industry Regulatory Organization of Canada (IIROC) to consider two motions in the matter of Denyse Giroux-Garneau.
The motions were filed by consent by counsel for Ms. Giroux-Garneau and by counsel for IIROC, for the purpose of obtaining the following orders:
a) |
A motion for leave to introduce into evidence a sworn statement by Ms. Giroux-Garneau which was communicated in advance to counsel for IIROC and transmitted to the members of the Hearing Panel on February 4, 2016; and |
b) |
A motion for leave to plead in writing. |
Following the hearing held on February 4, 2016, in Montréal, Québec, the Hearing Panel of IIROC ruled as follows:
a) |
Allows the introduction into evidence in the matter before it of a "Narrative History" sworn by Ms. Giroux-Garneau, under Exhibit I-1; and |
b) |
Allows the presentation of closing addresses by the counsels for the parties in the form of written arguments, said arguments to be filed in the record of the hearing, no later than February 19, 2016 in the case of counsel for Ms. Giroux-Garneau, and no later than March 8, 2016 in the case of counsel for IIROC. |

The two motions relate to a disciplinary proceeding initiated against Ms. Giroux-Garneau, in which it is alleged that she failed to inform her employer of the death of her client and to update the client's account form, and that she carried out unauthorized transactions in that client's account four months after his death for the purpose of appropriating the amount of $15,972.88.

IIROC formally initiated the investigation into Ms. Giroux-Garneau's conduct in June 2014. The conduct occurred while Ms. Giroux-Garneau was a Registered Representative at the Montreal branch of Industrial Alliance Securities Inc., an IIROC-regulated firm. Ms. Giroux-Garneau is no longer a registrant with an IIROC-regulated firm.
