MONTREAL, April 11, 2019 /CNW Telbec/ - L'Aréna du Rocket Inc. ("ADR"), manager of Place Bell, announced today that it has no other choice than taking legal action against the Cité de la culture et du sport ("Cité"). This legal action comes after several unsuccessful attempts by ADR, since the fall of 2017, to find a solution with Cité and the City of Laval.
The bid won by ADR in 2011 to manage Place Bell was clearly contemplating that no realty taxes would be payable except for the commercial space occupied by ADR's business partners. Hence why the partnership agreement signed by ADR and Cité in January 2013 provides for a financial contribution from Cité to ADR in an amount corresponding to the realty taxes paid by ADR on the entire amphitheatre, except for the space occupied exclusively by ADR or its business partners.
However, since the opening of Place Bell in August 2017, Cité has failed to pay such financial contribution to ADR.
There is no question that ADR is willing to pay realty taxes for the space occupied exclusively by ADR or its business partners, such as the offices, the Tricolore team store, the Taverne Moderne restaurant and the commercial space occupied by ADR's business partners. However, the ADR wants the Cité to honour its contractual commitment to pay the financial contribution for space that is not exclusive to ADR in the same way that ADR has fulfilled its contractual commitments to Cité.
ADR is proud of the work accomplished since the opening of Place Bell and wishes to continue to contribute to the cultural and sporting scene in Laval and the entire North Shore of Montreal.
