Law Society Tribunal Regulatory Proceedings for October 2014
TORONTO, Nov. 10, 2014 /CNW/ - The Law Society of Upper Canada regulates the lawyers and paralegals of Ontario in the public interest. The Law Society ensures that all lawyers and licensed paralegals in Ontario meet standards of learning, professional competence and professional conduct that are appropriate for the legal services provided.
The Law Society Tribunal recently heard the following matters. The Tribunal, which is an independent administrative tribunal within the Law Society, is responsible for processing, hearing and deciding these cases.
David Charles Besant (1974) of the City of Toronto
Decision: The Lawyer's appeal from the order dated December 11, 2013 was allowed in part. Four of the five findings of misconduct were upheld, while the other was set aside.
Bryan Richard Dale (1994) of the City of Markham
Decision: The Lawyer's licence to practise law is revoked, effective October 10, 2014.
Marie Louisa L. Diaz (2002) of the City of Markham
Decision: The Lawyer was suspended for seventy-five days, beginning December 1, 2014.
Junior Osas Ebagua (2009) of the City of Toronto
Decision: The Paralegal's appeal was dismissed and no costs are awarded on the appeal.
Clinton Vernol Ellis (1982) of the City of Markham
Decision: The Lawyer shall be suspended for 18 months and shall abide by specified terms.
Joseph Omer Jean-Michel Farant (1991) of the City of Kingston
Decision: The Respondent's licence to practise law was revoked.
Victor Manuel Castillo Garcia (2010) of the City of Toronto
Decision: The Paralegal's licence was suspended on an interim interlocutory basis, commencing October 23, 2014.
Rita Grewal (2011) of the City of Mississauga
Decision: The Lawyer is suspended on an interlocutory basis.
Peter Hatch (1987) of the City of Toronto
Decision: The Lawyer's licence was suspended for one month, starting immediately.
Jeunesse Leelawatie Hosein (1994) of the City of Toronto
Decision: The Lawyer is permitted to surrender her licence and did so at the hearing.
Arman Emanuel Hoque (2004) of the City of Mississauga
Decision: The Lawyer was reprimanded.
Brian Byoungeul Im (1986) of the City of Toronto
Decision: The Lawyer was suspended for two months commencing October 1, 2014 and must comply with specified conditions.
Hamza Nurdin Hassan Kisaka (1996) of the City of Toronto
Decision: The Lawyer is suspended for two weeks commencing on October 1, 2014 and continuing indefinitely until specified conditions have been met.
Claudio Martini (1989) of the City of Windsor
Decision: The Lawyer was suspended for seven months, starting 45 days from October 8, 2014 unless the parties agree otherwise.
Patrick Thomas Edward Corkery McCool (1984) of the City of Toronto
Decision: The Lawyer was invited to attend before the member of the Hearing Division. Following the attendance the notice of application was dismissed.
David Auston Mercury (1995) of the City of Whitby
Decision: The Lawyer was suspended, commencing October 28, 2014, and continuing indefinitely until he has satisfied specified conditions.
Edmund Peterson (1987) of the City of Toronto
Decision: The Lawyer's licence to practise law was revoked.
Katherine Suzanne Sam (2004) of the City of Toronto
Decision: The Lawyer was ordered to pay costs of $1,500 to the Law Society.
Stanley James Thomas (1975) of the City of Sudbury
Decision: The Lawyer shall be suspended for one month, starting two weeks from October 28, 2014 or on such other date as the parties may agree.
Eugenio Totera (2000) of the Town of Richmond Hill
Decision: The Law Society's appeal is allowed, and a new hearing is ordered.

Decision: The Lawyer shall pay costs of $5,000 to the Law Society.
Irving Wolkowicz (1980) of the City of Toronto
Decision: The Lawyer was reprimanded and ordered to pay a fine of $10,000.
