DETAILS: | This Application for Judicial Review asks the Court to declare that the Minister acted unreasonably and that the Minister's new Feed-in-Tariff ("FIT") Program Directives are unfair, discriminatory and not authorized by the enabling legislation. |
The Application also asks for the court to order the Minister to direct the OPA to process existing applications in accordance with the previous rules. | |
The hearing will be held on Friday morning, when the Ontario Superior Court of Justice, Divisional Court will consider an Application from the SkyPower group of companies for Judicial Review in the Ontario Superior Court of Justice against the Minister of Energy and the Ontario Power Authority ("OPA"). The Application concerns the Minister's recent Directives to change the FIT Program, retroactively affecting existing applications for FIT contracts that had previously been deemed complete and eligible by the OPA. | |
