MFDA announces disciplinary proceeding in respect of Vasant Avhad
TORONTO, April 4, 2018 /CNW/ - The Mutual Fund Dealers Association of Canada ("MFDA") has commenced disciplinary proceedings in respect of Vasant Avhad ("Respondent"). In its Notice of Hearing dated February 16, 2018, Staff of the MFDA alleges that the Respondent engaged in the following conduct contrary to the By-laws, Rules and/or Policies of the MFDA:
Allegation #1: Between December 30, 2015 and January 7, 2016, the Respondent opened two accounts for a client, recorded the client's Know-Your-Client information, and processed two transactions in the client's accounts without having met or communicated with the client, thereby failing to use due diligence to learn the essential facts relative to a client and to each order or account accepted, contrary to MFDA Rules 2.2.1 and 2.1.1; and
Allegation #2: On or about December 30, 2015, the Respondent created a note on the Member's back office system which falsely indicated that he met with a client to open two accounts at the Member, contrary to MFDA Rule 2.1.1.
The first appearance in this proceeding will take place by teleconference before a Hearing Panel of the MFDA's Prairie Regional Council on April 23, 2018 at 10:00 a.m. (Mountain), or as soon thereafter as the appearance can be held, to schedule a date for the commencement of the hearing on the merits and to address any other procedural matters. The appearance will be open to the public, except as may be required for the protection of confidential matters. The Hearing on the Merits will take place in Edmonton, Alberta at a time and venue to be announced.
