Nalcor Energy Files Application for Administrative Revision with Régie de
l'énergie
ST. JOHN'S, NL, June 10 /CNW/ - Nalcor Energy has filed an Application for Administrative Revision with the Régie de l'énergie (Régie). The application addresses the Régie's ruling released on May 11, 2010 in response to complaints filed by Newfoundland and Labrador Hydro, a subsidiary of Nalcor Energy, against Hydro-Québec TransÉnergie.
"Filing an Application for Administrative Revision is the first step to appeal the May 11 decision, and is necessary before pursuing any other appeal option," said Ed Martin, President and CEO, Nalcor Energy. "Given the substantive and procedural defects underlying the Régie's decision, we are seeking a revision of the decisions that will result in the reinstatement of our transmission service requests in the Hydro-Québec TransÉnergie reservation queue."
The administrative revision will be the subject of a public hearing before a new panel of three Régie de l'énergie Commissioners. There are no prescribed timelines for this review.
As part of options being pursued by Nalcor to develop the Lower Churchill Project, the company has been seeking to export power across the Québec transmission system from the approximately 3,000 MW Lower Churchill Hydroelectric Project in Labrador. As a result of a refusal by Hydro-Québec to provide fair access, Nalcor filed complaints with the Régie de l'énergie, for a hearing based on the principles of open access and non-discrimination. The Régie ruled solely in favour of Hydro-Québec and dismissed all legitimate arguments presented by Nalcor.
