NEB to consider SEMI and Imperial's application for toll relief together with
Enbridge's application for final tolls
CALGARY, May 13 /CNW/ - The National Energy Board (NEB or the Board) today released Hearing Order RH-2-2010, which outlined the details of a consolidated public hearing in which it will consider Suncor Energy Marketing Inc. (SEMI) and Imperial Oil's (Imperial) application for toll relief together with the contested portion of Enbridge's application for 2010 final tolls and tariffs for the Mainline System.
The oral part of the hearing process is scheduled to start at 9:00 a.m. local time on Tuesday, 9 November 2010, in the Board's hearing room in Calgary, Alberta.
On 22 February 2010, SEMI and Imperial filed a joint application for toll relief related to the inclusion in tolls of costs associated with the Alberta Clipper pipeline and relief from certain provisions of the tariff. In addition, on 31 March 2010, Enbridge filed an application for approval of its 2010 Incentive Toll Settlement and approval of 2010 final tolls and tariffs for the Mainline System effective 1 May 2010.
On 23 April 2010, the NEB issued a letter stating that SEMI and Imperial's application questioned whether Enbridge's proposed final tolls are just and reasonable. In the letter, the Board noted that Enbridge has the burden of proving that its proposed final tolls are just and reasonable, including that costs were prudently incurred. Therefore, in substance Enbridge is the applicant and SEMI and Imperial are intervenors and the hearing process will be conducted accordingly. The consolidation of the applications is meant to encourage regulatory efficiency.
Any person wishing to participate in this hearing process may do so in one of two ways:
i. by filing an application to intervene with the Secretary of the Board and serving a copy on Enbridge and its counsel, and on SEMI and Imperial and their counsel by 10 June 2010; or ii. by filing a letter of comment with the Secretary of the Board and serving a copy on Enbridge and its counsel by 25 August 2010.
