Non-conformities with environmental requirements and municipal bylaws - THE
VERDUN BOROUGH SERVES A FORMAL DEMAND ON THE DEVELOPER OF GOLF ÎLE DES
SŒURS FOR DEFAULTING ON CONDITIONS OF CONTRACTS
VERDUN, QC, Sept. 28 /CNW Telbec/ - Verdun Borough Mayor Claude Trudel has asked his Administration to serve a formal demand on Golf Ile des Sœurs (6358098 Canada inc.) because it is not complying with a number of environmental requirements of the Ministère du Développement durable, de l'Environnement et des Parcs (MDDEP) and is contravening various municipal bylaws.
At a press conference, Mayor Trudel was deeply concerned about the fact that developer Pierre Émond was not responding to the many requests made by the Borough to comply with the clauses of the agreements signed between the two parties. He said that the developer is moreover not fulfilling his obligations with regard to the MDDEP's certificate of authorization.
"The developer talks about his golf course as being an ecological one, but he isn't protecting the environment. The many defaults in the conditions of the contracts are unacceptable. The developer's casual attitude is disrespectful to our residents and the other developers that are active on our territory and abide by the rules and regulations," stated Mayor Trudel.
In particular, the developer is in default with regard to the following:
- A water retention pond installed along the 8th hole is connected directly to the storm sewer, without storing any water. - At the 7th hole, protective netting and the wooden posts for this installation are largely encroaching on the territory of a green corridor set up to ensure the passage of birds from the St. Lawrence River to Boisé Saint-Paul. - The 8th tee is definitely encroaching on the green corridor. - At the 9th hole, at the outer limits of the neighbouring spa, the developer has built a slope and a retaining wall without any authorization to do so.
"Over the past 20 years, the mayors before me and myself, along with residents' support, invested all our energy to protect Boisé Saint-Paul and the green corridor. I can't tolerate a developer acting in such a brutal way, by always confronting us with a fait accompli," stated Mayor Trudel.
Moreover, despite his written agreement to do so, the developer has not submitted the Borough, for its acceptance, a tee time reservation policy giving priority to Verdunites who have a valid Accès Verdun card.
After receiving the formal demand, the developer will have 90 days to remedy these defaults, failing which he will be liable to lose his entitlement to operate the golf course.
"Let me make myself clear: I'm not against the development of this golf course nor the installation of protective netting to ensure the safety of the residents living near these grounds; however, the developer, like everyone else, must comply with the agreements reached with my Administration. It's a matter of responsibility, respect and good common sense," added Mayor Claude Trudel in his closing remarks.
