Notice of the authorization of a class action
THIS NOTICE IS DIRECTED TO ALL PERSONS IN CANADA WHO TOOK DEPO-PROVERA.
MONTREAL, April 30 /CNW Telbec/ - TAKE NOTICE that on May 28, 2008, Justice Danielle Grenier of the Superior Court of Quebec authorized the institution of a class action against Pfizer Canada Inc. and Pfizer Inc. (the "Defendants"), in court file # 500-06-000305-058, Brito v. Pfizer Canada inc. and Pfizer inc. (the "Authorization judgment"), on behalf of all persons that are included in the class defined as follows:
"Every person domiciled in Canada who claims to be suffering or to have suffered a loss of bone mineral density owing to the use of DEPO-PROVERA." (the "Class")
Every person domiciled in Canada and who claim to be suffering or to have suffered a loss of bone mineral density because of the use of DEPO-PROVERA, is a member of the Class and its rights will be affected.
This class action aims to determine if the Defendants failed to fulfill certain of their legal and statutory obligations by misrepresenting the risks associated with the use of DEPO-PROVERA.
THE CLASS MEMBERS WHO WISH TO PARTICIPATE IN THE CLASS ACTION are automatically included and need not do anything at this time. OPT-OUT PROCEDURE
THE CLASS MEMBERS WHO DO NOT WISH TO PARTICIPATE IN THE CLASS ACTION, or do not want to be bound by any judgment or settlement in the class action, and who have not already brought a suit in their own name, must request their exclusion from the Class by notifying the clerk of the Superior Court of Quebec of the district of Montréal, by registered or certified mail, on or before May 31, 2010 to the following address:

A Class member should not opt out if he or she wishes to participate in the class action. A Class member who opts out will not be eligible for any recovery in the class action.

This text is a summary of the terms of the complete version of the notice to the members and of the Authorization judgment. If there is any conflict between the provisions of this text, the complete version of the notice to the members and the terms of the Authorization judgment, the complete version of the notice to the members or the Authorization judgment shall prevail.
