Investigations under Section 22 of the Ministry of Correctional Services Act are triggered following incidents between staff and inmates that are considered significant contraventions of directives, policies, procedures, and standards of professional conduct.
Monte Vieselmeyer, chair of the Ministry Employee Relations Committee for Correctional Services, said the excessive length of time that correctional officers are under investigation punishes them – whether or not they are guilty.
"Under Section 22, they have no right to legal counsel, nor do they enjoy the right to be presumed innocent," he explained. "In short, these officers enjoy fewer rights than any other citizen who has been charged with an offence. Who is looking out for the rights and mental health of these officers?"
