/R E P E A T -- Media advisory - Medical Aid in Dying: two Montrealers go to court to regain their right to die with dignity/

MONTREAL, June 13, 2017 /CNW Telbec/ - An action was filed Tuesday afternoon in the Superior Court of Québec to challenge the constitutionality of the Canadian and Quebec laws on medical aid in dying. These two laws restrict access to medical aid in dying to individuals who are at the end of their lives or whose death is reasonably foreseeable, a requirement incompatible with the principles outlined in the Carter decision rendered by the Supreme Court of Canada in February 2015.

This court action is undertaken by two Montrealers suffering from degenerative diseases who are not eligible obtain medical aid in dying under these laws because they are not at the end of their lives and their deaths are not reasonably foreseeable, although their situations satisfy all the other criteria under both laws. A few days before the first anniversary of the enactment of Bill C-14, they are asking the court to allow doctors to provide them with medical aid in dying and to invalidate the articles of these laws setting these criteria.

A press conference will be held at the offices of Ménard, Martin avocats, with the two plaintiffs and their lawyer, Me Jean-Pierre Ménard.
