TORONTO, Nov. 12, 2015 /CNW/ - The law firm Siskinds LLP has launched a class action regarding Zofran.
Zofran is approved to treat nausea and vomiting in patients following chemotherapy, radiation or surgery. However, Zofran has been prescribed off-label to treat morning sickness in expectant mothers. Some studies have noted an association between Zofran use in the first trimester of pregnancy and birth defects such as congenital cardiac (heart) malformations and oral clefts (cleft lip and/or cleft palate).
In commencing this class action, Siskinds seeks to recover compensation for persons in Canada who experienced these conditions as a result of their mothers being prescribed Zofran. The Statement of Claim alleges that the defendant failed to adequately warn expectant mothers and physicians that use of Zofran during the first trimester of pregnancy increases the risk of serious birth defects.
Jill McCartney, a lawyer with Siskinds LLP, states: "As a matter of safety, expectant mothers and their health care providers need to be informed of the risks associated with using a particular pharmaceutical product. This is particularly true during the first trimester of pregnancy, when the baby is developing his or her organs."
