TNW Networks Corp (TNW Networks) Corrects Certain Information Related to a Consumer Alert Message Issued by The Canadian Radio-television and Telecommunications Commission (CRTC) regarding a Dispute between one of TNW Networks' Underlying Carriers and TELUS Communications Company (TELUS)

VANCOUVER, Nov. 21, 2016 /CNW/ - TNW Networks Corp (TNW Networks) a national independent telecommunications service provider wishes to correct a "Consumer Alert" issued by the CRTC on September 22, 2016 stating that certain clients of one of its underlying carriers, 8640025 Canada Inc. (8640) may see some of its services being affected on November 21st 2016 due to a commercial dispute with TELUS.
As a result, 8640 sought and received court assistance, and therefore no service will be affected.
From its origin in 1957 as BC Rail Telecom, to its recent evolution as TNW Networks, the company is now one of the largest independent facilities-based operators in Canada and one of the largest competitors to TELUS in the Province of British Columbia.
TNW Networks believes that there is a very fragile balance in a business relationship when an ILEC is simultaneously in a dominant position as well as a competitor and supplier. TNW Networks further believes this fine line has been crossed, potentially to the detriment of TNW Networks' operation and more importantly to its customers.
8640 alleges that during the period of August 2015 to January 2016, TELUS interfered directly with the ongoing acquisition by 8640 of another Canadian telecom operator and an AWS spectrum license.
Although 8640 currently holds a significant amount of licensed frequency spectra through Industry Canada for its network, none are in the Advanced Wireless Services (AWS) spectrum band required for its proprietary data only iPCS cloud-based Smartphone-over-IP mobile service.
The interference and resulting inability to acquire the company and license has resulted in a delay to launch TNW Network's mobile service in the Canadian wireless market.
As an amicable settlement was not possible, 8640 needed to mitigate its damages and was left with no other choice but to file a Notice of Civil Claim against TELUS in the Supreme Court of British Columbia.
8640 also filed a complaint with the Competition Bureau of Canada, alleging that through a series of actions, TELUS violated parts of the Canadian Competition Act related to abuse of a dominant position and anti-competitive practices.
"We regret that the situation with TELUS has evolved to the point where we need to take legal action," stated Sandeep Panesar, CEO of TNW Networks. "However as we have learned with the litigation success of other smaller Canadian telecommunications operators, the courts seem to be the only place to settle such matters and allow Canadians to truly benefit from a fair and competitive marketplace."
