Trindent obtains consent Court Order and injunction against Carpedia, Peter Hryniak and Jordan de Lima
TORONTO, Feb. 23, 2017 /CNW/ - Trindent Management Consulting Inc. ("Trindent") announced that it has obtained a consent order against Carpedia International Ltd. ("Carpedia"), Peter Hryniak and Jordan de Lima following filing a motion for injunctive relief. The Order requires that the defendants must return all confidential and proprietary information to Trindent, and that Hryniak and de Lima are restrained from soliciting certain clients, prospective clients and employees of Trindent. In addition, the defendants agreed to provide Trindent with $30,000.00 in costs for having to file the motion.

THIS MOTION made by the plaintiff, Trindent Management Consulting Inc., for injunctive relief against the defendants herein, was read this day at the Courthouse, 393 University Avenue, Toronto, ON;
ON READING the consent of the parties filed, this Court orders that:
- THIS COURT ORDERS THAT the defendant Peter Hryniak is restrained until September 2, 2017, from soliciting or in any way interfering with the business relationship between Trindent and, any client or customer with which he did business on Trindent's behalf for the period of September 2, 2015 to September 2, 2016, where such solicitation or interference is to any degree for the purpose of diverting the client or customer's business away from Trindent. This restriction also applies to any prospective clients or customers of Trindent that Peter Hryniak contacted for the purpose of selling or performing Trindent's services for the period of September 2, 2015 to September 2, 2016.
- THIS COURT ORDERS THAT the defendant, Jordan de Lima is restrained until September 2, 2017 from soliciting or in any way interfering with the business relationship between Trindent and, any client or customer with which he did business on Trindent's behalf for the period of September 2, 2015 to September 2, 2016, where such solicitation or interference is to any degree for the purpose of diverting the client or customer's business away from Trindent. This restriction also applies to any prospective clients or customers of Trindent that Jordan de Lima contacted for the purpose of selling or performing Trindent's services for the period of September 2, 2015 to September 2, 2016.
- THIS COURT ORDERS THAT the defendant Peter Hryniak is restrained until September 2, 2017 from soliciting for employment or other engagement for Carpedia International Ltd., or any business in which Peter Hryniak is a partner, joint venture, employee, principal, consultant, agent, shareholder, officer or director, any person who was employed by Trindent from September 2, 2015 and September 2, 2016.
- THIS COURT ORDERS THAT the defendant Jordan de Lima is restrained until September 2, 2017 from soliciting for employment or other engagement for Carpedia International Ltd., or any business in which Jordan de Lima is a partner, joint venture, employee, principal, consultant, agent, shareholder, officer or director, any person who was employed by Trindent from September 2, 2015 and September 2, 2016.
- THIS COURT ORDERS THAT the defendants herein shall return all confidential or proprietary information in any form belonging to Trindent as defined in section 11 of the employment agreements executed by the Defendants ("Trindent Confidential Information") that is in their possession, custody or control without retaining copies in any form.
- THIS COURT ORDERS THAT the defendants will not disclose, use or misuse any Trindent Confidential Information for their personal benefit, for the benefit of any third party or for any purposes whatsoever.
- THIS COURT ORDERS THAT the defendants shall maintain and preserve a complete record of all printed and electronic communications with clients or prospective clients with which Hryniak and/or de Lima did business on Trindent's behalf for the period of September 2, 2015 to September 2, 2016.
- THIS COURT ORDERS THAT the defendants shall pay to the plaintiff the sum of $30,000.00 in costs including all disbursements and HST.
- THIS COURT ORDERS THAT the balance of the motion for injunctive relief herein is dismissed on a with prejudice basis.
- THIS ORDER BEARS interest at the rate of 2% per year commencing on February 3, 2017.
