Via Rail train derailment class action lawsuit certified

Court rules that the class action can proceed

TORONTO, Nov. 1, 2012 /CNW/ - The action arising out of the derailment of Via Rail train #92 near Aldershot, Ontario on February 26, 2012, was certified as a class action.

"The court has determined that the matter can proceed through the courts as a class action which is a critical step in obtaining justice for the many innocent victims of this tragedy", said Harvey Strosberg, Q.C. of Sutts, Strosberg LLP.

The certification order allows the matter to proceed against the defendants, including Via Rail Canada Inc. and Canadian National Railway Company.

The class action seeks compensation for physical and emotional injury, damage to property and loss of income to approximately 68 people who were passengers on the train at the time of the derailment.
